{"id":533,"date":"2025-05-08T10:29:13","date_gmt":"2025-05-08T10:29:13","guid":{"rendered":"https:\/\/hicostablanca.com\/regulamin\/"},"modified":"2025-07-29T11:55:24","modified_gmt":"2025-07-29T11:55:24","slug":"regulamin","status":"publish","type":"page","link":"https:\/\/hicostablanca.com\/en\/regulamin\/","title":{"rendered":"STORE TERMS AND CONDITIONS"},"content":{"rendered":"\n<p><strong>STORE REGULATIONS<\/strong><\/p>\n\n<p><strong>\u00a71 General provisions<\/strong><\/p>\n\n<p>The online store operating at <a href=\"https:\/\/hicostablanca.com\/en\/\">https:\/\/hicostablanca.com<\/a> is operated by Joanna Cymbalista, conducting business under the name of Joanna Cymbalista, based at 6 Malinowa Street, 55-003 Chrz\u0105stawa Ma\u0142a, registered in the Central Register and Information on Business Activity (CEIDG), NIP: 7532385530, REGON: 389254472.<br\/>These Regulations define the rules for the use of the store, placing orders, payments, order execution and the rights of the consumer and the so-called privileged entrepreneur.<br\/>The store offers digital products &#8211; e-books &#8211; in a format that allows them to be downloaded by the customer.  <\/p>\n\n<p><strong>\u00a72 Definitions<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Customer<\/strong> &#8211; an individual, legal entity or organizational unit making a purchase in the store.<\/li>\n\n\n\n<li><strong>Product<\/strong> &#8211; digital content in the form of an e-book offered by the store.<\/li>\n\n\n\n<li><strong>Store<\/strong> &#8211; online store available at <a href=\"https:\/\/hicostablanca.com\/en\/\">https:\/\/hicostablanca.com.<\/a><\/li>\n\n\n\n<li><strong>Vendor<\/strong> &#8211; Joanna Cymbalista.<\/li>\n\n\n\n<li><strong>Regulations<\/strong> &#8211; this document.<\/li>\n\n\n\n<li><strong>Privileged entrepreneur<\/strong> &#8211; an individual who enters into a contract directly related to his business activity, when it is clear from the content of the contract that it is not of a professional nature for that person.<\/li>\n<\/ul>\n\n<p><strong>\u00a73 Contacting the store<\/strong><\/p>\n\n<p>In matters related to the operation of the store, orders, complaints or other issues, the Customer can contact the Seller:<br\/>\ud83d\udce7 e-mail: <strong>kontakt@hicostablanca.com<\/strong><br\/>The store responds to messages on business days from 9:00 a.m. to 5:00 p.m., within a maximum of 3 business days.<\/p>\n\n<p><strong>\u00a74 Placing orders<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Orders can be placed 24 hours a day through the store&#8217;s website.<\/li>\n\n\n\n<li>To place an order, please:\n<ol class=\"wp-block-list\">\n<li>select a product,<\/li>\n\n\n\n<li>add it to your cart,<\/li>\n\n\n\n<li>provide contact information,<\/li>\n\n\n\n<li>make payment.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>The customer is obliged to provide true personal information.<\/li>\n<\/ul>\n\n<p><strong>\u00a75 Prices and payments<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>All prices on the site are gross prices (including VAT).<\/li>\n\n\n\n<li>Payments are made through available electronic payment systems.<\/li>\n\n\n\n<li>Order processing begins after payment is credited.<\/li>\n<\/ul>\n\n<p><strong>\u00a76 Order execution and delivery<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>The digital product is delivered in the form of a download link sent to the customer&#8217;s email address.<\/li>\n\n\n\n<li>Lead time: max. 24 hours after receipt of payment.<\/li>\n\n\n\n<li>The customer is responsible for the accuracy of the e-mail address provided.<\/li>\n<\/ul>\n\n<p><strong>\u00a77 Right of withdrawal<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>According to Art. 38. 1 point 13 of the Consumer Rights Act, the right to withdraw from the contract does not apply to the supply of digital content that is not recorded on a tangible medium, if the performance began with the express consent of the consumer.<\/li>\n\n\n\n<li>By making a purchase, the customer agrees to start the service before the expiration of the deadline for withdrawal from the contract, resulting in its loss.<\/li>\n\n\n\n<li>The right of withdrawal also applies to <strong>a privileged entrepreneur<\/strong>, i.e. an individual concluding a contract related to <strong>his<\/strong> business activity, <strong>if the contract is not of a professional nature for him<\/strong>. However, this right <strong>also does not apply<\/strong> if the performance began with his consent before the expiration of the withdrawal period.  <\/li>\n<\/ol>\n\n<p><strong>\u00a78 Complaints<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>Complaints should be submitted electronically to: <strong>kontakt@hicostablanca.com.<\/strong><\/li>\n\n\n\n<li>The complaint should include:\n<ul class=\"wp-block-list\">\n<li>customer data,<\/li>\n\n\n\n<li>The email address used during the purchase,<\/li>\n\n\n\n<li>order number (if available),<\/li>\n\n\n\n<li>problem description,<\/li>\n\n\n\n<li>proof of purchase (e.g., payment receipt, invoice).<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n<ol class=\"wp-block-list\">\n<li>Complaints are processed within 14 working days.<\/li>\n\n\n\n<li>If the complaint is accepted, the Seller:<\/li>\n<\/ol>\n\n<ol class=\"wp-block-list\">\n<li>provides the correct version of the Product or<\/li>\n\n\n\n<li>will propose another solution, such as a partial or full refund.<\/li>\n\n\n\n<li>The complaint procedure applies to both consumers and <strong>privileged businesses<\/strong>.<\/li>\n<\/ol>\n\n<p><strong>\u00a79 Protection of personal data<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>The administrator of the personal data is Joanna Cymbalista.<\/li>\n\n\n\n<li>Data is processed only for the purpose of order processing and customer service, in accordance with the privacy policy.<\/li>\n\n\n\n<li>The customer has the right to inspect, correct and request the deletion of his personal data.<\/li>\n<\/ol>\n\n<p><strong>\u00a710 Technical requirements<\/strong><\/p>\n\n<p>To use the Digital Products, the Customer must have:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>device with Internet access,<\/li>\n\n\n\n<li>A current browser (e.g. Chrome, Firefox, Safari),<\/li>\n\n\n\n<li>A program to open PDFs (such as Adobe Acrobat Reader),<\/li>\n\n\n\n<li>active e-mail address.<br\/>Failure to meet the technical requirements may prevent the use of the Product, for which the Seller is not responsible.<\/li>\n<\/ul>\n\n<p><strong>\u00a711 e-book license<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>The purchase of the Product implies the granting of <strong>a non-exclusive, non-transferable license<\/strong> to the Customer for personal use.<\/li>\n\n\n\n<li>The customer has no right to:\n<ul class=\"wp-block-list\">\n<li>Copy, share, publish the e-book (in whole or in part),<\/li>\n\n\n\n<li>resale or sublicensing,<\/li>\n\n\n\n<li>deletion of author designations.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The license is valid indefinitely and includes use on the Customer&#8217;s own devices.<\/li>\n<\/ol>\n\n<p><strong>\u00a712 Final provisions<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>Contracts are concluded in Polish.<\/li>\n\n\n\n<li>The seller reserves the right to change the Terms and Conditions for important reasons (e.g. changes in the law, payment systems), informing the customer 7 days in advance.<\/li>\n\n\n\n<li>In matters not regulated, the provisions of Polish law shall apply, in particular:\n<ul class=\"wp-block-list\">\n<li>Civil Code,<\/li>\n\n\n\n<li>Law on Provision of Electronic Services,<\/li>\n\n\n\n<li>Consumer Rights Law,<\/li>\n\n\n\n<li>Data Protection Law.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The customer can use out-of-court dispute resolution &#8211; for example, through the EU ODR platform: <a href=\"http:\/\/ec.europa.eu\/consumers\/odr\/\">http:\/\/ec.europa.eu\/consumers\/odr\/<\/a><\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>STORE REGULATIONS \u00a71 General provisions The online store operating at https:\/\/hicostablanca.com is operated by Joanna Cymbalista, conducting business under the name of Joanna Cymbalista, based at<span class=\"excerpt-hellip\"> [\u2026]<\/span><\/p>\n","protected":false},"author":3,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-533","page","type-page","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/pages\/533","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/comments?post=533"}],"version-history":[{"count":3,"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/pages\/533\/revisions"}],"predecessor-version":[{"id":581,"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/pages\/533\/revisions\/581"}],"wp:attachment":[{"href":"https:\/\/hicostablanca.com\/en\/wp-json\/wp\/v2\/media?parent=533"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
