STORE REGULATIONS

§1 General provisions

The online store operating at https://hicostablanca.com is operated by Joanna Cymbalista, conducting business under the name of Joanna Cymbalista, based at 6 Malinowa Street, 55-003 Chrząstawa Mała, registered in the Central Register and Information on Business Activity (CEIDG), NIP: 7532385530, REGON: 389254472.
These Regulations define the rules for the use of the store, placing orders, payments, order execution and the rights of the consumer and the so-called privileged entrepreneur.
The store offers digital products – e-books – in a format that allows them to be downloaded by the customer.

§2 Definitions

  • Customer – an individual, legal entity or organizational unit making a purchase in the store.
  • Product – digital content in the form of an e-book offered by the store.
  • Store – online store available at https://hicostablanca.com.
  • Vendor – Joanna Cymbalista.
  • Regulations – this document.
  • Privileged entrepreneur – an individual who enters into a contract directly related to his business activity, when it is clear from the content of the contract that it is not of a professional nature for that person.

§3 Contacting the store

In matters related to the operation of the store, orders, complaints or other issues, the Customer can contact the Seller:

The store responds to messages on business days from 9:00 a.m. to 5:00 p.m., within a maximum of 3 business days.

§4 Placing orders

  • Orders can be placed 24 hours a day through the store’s website.
  • To place an order, please:
    1. select a product,
    2. add it to your cart,
    3. provide contact information,
    4. make payment.
  • The customer is obliged to provide true personal information.

§5 Prices and payments

  • All prices on the site are gross prices (including VAT).
  • Payments are made through available electronic payment systems.
  • Order processing begins after payment is credited.

§6 Order execution and delivery

  • The digital product is delivered in the form of a download link sent to the customer’s email address.
  • Lead time: max. 24 hours after receipt of payment.
  • The customer is responsible for the accuracy of the e-mail address provided.

§7 Right of withdrawal

  1. According to Art. 38. 1 point 13 of the Consumer Rights Act, the right to withdraw from the contract does not apply to the supply of digital content that is not recorded on a tangible medium, if the performance began with the express consent of the consumer.
  2. By making a purchase, the customer agrees to start the service before the expiration of the deadline for withdrawal from the contract, resulting in its loss.
  3. The right of withdrawal also applies to a privileged entrepreneur, i.e. an individual concluding a contract related to his business activity, if the contract is not of a professional nature for him. However, this right also does not apply if the performance began with his consent before the expiration of the withdrawal period.

§8 Complaints

  1. Complaints should be submitted electronically to: kontakt@hicostablanca.com.
  2. The complaint should include:
    • customer data,
    • The email address used during the purchase,
    • order number (if available),
    • problem description,
    • proof of purchase (e.g., payment receipt, invoice).
  1. Complaints are processed within 14 working days.
  2. If the complaint is accepted, the Seller:
  1. provides the correct version of the Product or
  2. will propose another solution, such as a partial or full refund.
  3. The complaint procedure applies to both consumers and privileged businesses.

§9 Protection of personal data

  1. The administrator of the personal data is Joanna Cymbalista.
  2. Data is processed only for the purpose of order processing and customer service, in accordance with the privacy policy.
  3. The customer has the right to inspect, correct and request the deletion of his personal data.

§10 Technical requirements

To use the Digital Products, the Customer must have:

  • device with Internet access,
  • A current browser (e.g. Chrome, Firefox, Safari),
  • A program to open PDFs (such as Adobe Acrobat Reader),
  • active e-mail address.
    Failure to meet the technical requirements may prevent the use of the Product, for which the Seller is not responsible.

§11 e-book license

  1. The purchase of the Product implies the granting of a non-exclusive, non-transferable license to the Customer for personal use.
  2. The customer has no right to:
    • Copy, share, publish the e-book (in whole or in part),
    • resale or sublicensing,
    • deletion of author designations.
  3. The license is valid indefinitely and includes use on the Customer’s own devices.

§12 Final provisions

  1. Contracts are concluded in Polish.
  2. The seller reserves the right to change the Terms and Conditions for important reasons (e.g. changes in the law, payment systems), informing the customer 7 days in advance.
  3. In matters not regulated, the provisions of Polish law shall apply, in particular:
    • Civil Code,
    • Law on Provision of Electronic Services,
    • Consumer Rights Law,
    • Data Protection Law.
  4. The customer can use out-of-court dispute resolution – for example, through the EU ODR platform: http://ec.europa.eu/consumers/odr/
